General terms and conditions training courses on open registration

Article 1. Definitions

In these terms and conditions, the following terms have the following meaning:

  • AIF: the professional who operates under the name Agile In Focus.

  • participant: the participant who follows a training on open registration

  • The agreement: the agreements between the participant and AIF.

Article 2. General

  1. These conditions apply to all training courses of AIF, which are offered on open registration and for which the participant has registered.

  2. If a situation arises between the parties that is not regulated in these general terms and conditions, this situation must be assessed in the spirit of these general terms and conditions.

  3. All information provided by or about participants or clients will be treated confidentially by AIF before or during the training and of which this information can be expected to be confidential in nature.

  4. Teaching materials provided to participants during training become their property (or, if applicable, their employer's). The intellectual property related to the training and teaching materials is reserved by AIF.

  5. The copyright of all teaching materials provided before, during or after the training courses rests with AIF. Copying (parts of) teaching material or providing it to third parties is only permitted after written permission from AIF.

Article 3. Suspension, dissolution and early termination of the agreement

  1. AIF is authorized to suspend the fulfillment of the obligations or to dissolve the agreement if the participant does not, not fully or not timely fulfill the obligations under the agreement, after the agreement has been concluded.

  2. If the training is canceled by AIF due to force majeure, the full registration fee will be refunded. AIF is in no way obliged to compensate damage and costs that arise in any way as a result of the cancellation.

  3. The participant has a cooling-off period of fourteen (14) days after registration. When registering within fourteen (14) days before the start of the training, the reflection period ends when the training has started. The participant who wants to cancel the course must notify AIF by email that he or she cancels registration. Any course fees already paid will then be returned in full.

  4. If the participant cancels the registration no later than one (1) month before the start of the training, only the deposit will be charged. In case of cancellation within one month before the start of the training, the participant owes the full amount.

Article 4. Force majeure

  1. AIF is not obliged to fulfill any obligation towards the participant if AIF is prevented from doing so as a result of force majeure.

  2. If the trainer is unable to attend due to force majeure, a replacement will be sought or the training day will be cancelled. In the latter case, a new date will be set as soon as possible. No refund will be provided. In the case of the annual training, the following applies: if one of the trainers is unable to attend due to force majeure, the training day will be made up. In the unlikely event that more trainers drop out, a suitable solution will be offered. No refund will be provided.

  3. In these general terms and conditions, force majeure is understood to mean, in addition to what is understood in the law and jurisprudence, all external causes, foreseen or unforeseen, over which AIF can exercise no influence, but as a result of which AIF is unable to fulfill its obligations. .

Article 5. Payment and collection costs

  1. When the deposit of 20% of the full invoice amount has been received by AIF, the registration will be converted into a final registration.

  2. Full payment must be received by AIF no later than two (2) weeks before the start of the training. If the participant fails to pay the full invoice on time, the registration will be cancelled. There will then be no refund of the deposit.

Article 6. Liability

  1. If AIF should be liable, this liability is limited to what is regulated in this provision.

  2. AIF is not liable for damage, of whatever nature, caused by AIF acting on incorrect and/or incomplete information provided by or on behalf of the Participant.

  3. AIF's liability is in any case always limited to the amount paid out by its insurer, where appropriate.

  4. AIF is only liable for direct damage.

  5. AIF is never liable for indirect damage, including consequential damage, lost profit, lost savings and damage due to business interruption.

  6. The limitations of liability included in this article do not apply if the damage is due to intent or gross negligence on the part of AIF.
